Sentencing Tomorrow In Sexual Assault Case

A Sydney man at the centre of a lawsuit against the Wendy’s restaurant on Welton Street in Sydney is now scheduled to learn his sentence tomorrow after the hearing was adjourned today.  

25 year-old David Leonard MacDonald has pleaded guilty to five counts of sexual assault against former female work colleagues at the restaurant.

The Crown and defence recommended a sentence of a year in jail followed by two-years probation during a sentencing hearing last month, but provincial court Judge Dan MacRury said he’s concerned with the appropriateness of the sentence because there are five victims.

Two of the victims have filed a lawsuit against the franchise owner, accusing it of being negligent in allowing MacDonald to work with them even after police were investigating.
