by The Calgary man looking to overturn his conviction in the death of a Glace Bay man is taking his appeal to the Supreme Court of Canada.
Nicholas Rasberry was found guilty of manslaughter by a judge in 2015 in the 2013 death of Craig Kelloway.
The conviction was upheld by the Alberta Court of Appeal in May.
Lawyer Gavin Wolch says Rasberry stabbed Kelloway in self-defence because Kelloway threatened to sexually assault Rasberry and his wife.
Meanwhile, Kelloway’s mother Monica told CTV she’s fed up with the justice system and the crown prosecutors and wants a new trial.
Monica Kelloway goes on to say she doesn’t believe Rasberry’s self-defence argument.
Kelloway left behind a girlfriend and infant son.
Rasberry is out on bail while the Alberta Court of Appeal considers his sentence appeal.
