The Nova Scotia Court of Appeal has rejected a request by a Glace Bay man to cease deliberations of his appeal on a conviction of second-degree murder.
45-year-old Ted Thomas Barrett was convicted in 2016 in the death of 19-year-old Brett Elizabeth MacKinnon.
Barrett is appealing the conviction on the grounds that a statement from a witness who died before testifying at trial should have been inadmissible.
He filed notice earlier this month that he would represent himself, and asked the court to cease deliberations on arguments already advanced and to disregard his lawyer’s submissions.
While the court granted Barrett’s request to represent himself, the court denied his request to cease deliberations, saying such a request could only be granted in the clearest and most compelling of circumstances.
