Sentencing Delayed Again In Sexual Assault Case

Sentencing was adjourned again today for a Sydney man at the centre of a lawsuit against the Wendy’s restaurant on Welton Street in Sydney.

25 year-old David Leonard MacDonald has pleaded guilty to five counts of sexual assault against former female work colleagues at the restaurant.

The Crown and defence have recommended a sentence of a year in jail followed by two-years probation, but provincial court Judge Dan MacRury says he’s concerned with the appropriateness of the sentence given there are five victims.

Two of the victims have filed a lawsuit against the franchise owner, Roy Enterprises Ltd., claiming the company was negligent in continuing to allow MacDonald to work with them even after police were investigating.

MacDonald has been released on conditions and is now due to be sentenced on October 21st.
