Appeal Hearing For Dismissed Assault Case

Both the Crown and defence are due in Sydney Supreme Court today to set a date for an appeal hearing in a case that was dismissed because both the accused and accuser were sent to the wrong courtroom.

The case involves 28-year-old Jonas Lee McDonald from North Sydney who was charged with assault causing bodily harm against Joe Yorke.

McDonald’s trial was set to begin on February 22nd but both he and Yorke were sent to the second floor of the Sydney courthouse instead of the first floor.

Yorke suffered a broken jaw and cheekbone when he opened his door to a man he didn’t know in May of 2016 and was punched in the face.

The Crown is looking for the dismissal to be set aside and a new trial ordered.
