by The second degree murder trial of Thomas Ted Barrett is due to resume today after police managed to track a Crown witness that put the proceedings on hold, last week.
Ashley MacDonald is Barrett’s former girlfriend and the mother of his two children.
A witness warrant was issued for her and Regional Police travelled to British Columbia in the effort to find her.
40 year-old Barrett is charged in connection to the death of Brett Elizabeth MacKinnon from Glace Bay.
Her remains were found in woods in the community in 2008, two years after she was reported missing.
The first order of business when the trial resumes today is expected to be a closed-door session with Crown and defence lawyers.
At issue is whether damning video testimony from a witness can be entered as evidence.
Sheryl Flynn has since died from a drug overdose but in her videotaped statement she says Barrett confessed to her that he killed McKinnon.
Defence lawyer Brian Bailey has tried to poke holes in Flynn’s credibility, questioning why she came forward to police nearly three years after the confession.
Bailey has also suggested that Flynn was a police informant but Judge Robin Gogan has ruled that an informant can’t be revealed, even after they’re dead.
